New Requirements for the Registration of Foreign Workers in Georgia: Important Update for Employers

In 2023, significant amendments were made to the Georgian Law on Labor Migration, affecting the employment conditions of foreign nationals. The main innovation is the mandatory registration of foreign workers by employers on a specialized labor migration portal within 30 days of signing an employment contract. This change is aimed at improving the monitoring of compliance with immigrants' labor rights and simplifying the process of obtaining necessary visas and residence permits.

It is important to note that strict penalties have been introduced for non-compliance with these requirements. The initial fine for failing to meet the registration duty is 1,000 GEL, which can increase to 2,000 and 6,000 GEL for subsequent violations. These fines underscore the seriousness of the new regulatory requirements.

Furthermore, merely having an employment contract is no longer sufficient for obtaining a D1 visa category or a work residence permit. Foreign workers must be registered in the unified database of the Ministry of Labor, Health, and Social Protection of Internally Displaced Persons from the Occupied Territories of Georgia, which ensures their right to legally stay and work in the country.
